Everything You Need to Know About Witnesses of a Car Accident

October 19, 2022 by Big Leap

Having witnesses to a car accident can make a big difference in the outcome of the accident including how you are compensated by insurance companies. There’s a lot you and anyone else directly involved in the accident can say about what happened. However, a witness can improve your situation.

Types of Witnesses

In any accident, there are two main types of witnesses. The first is an eyewitness. This witness is anyone who watched the accident happen or observed your injuries after.  These witnesses are more believable if they are not passengers in the same car as you or are related to you.  The second type of witness is an expert witness. An expert witness can add more strength to your case by using science and help persuade the insurance companies and their attorneys of what compensation you need. Examples include medical or mental health professionals, accident reconstruction experts, engineers, highway safety experts, etc.

Benefits of a Witness Testimony

A strong witness is an objective third party that is present simply to state the facts of what happened. They offer no bias and simply testify of what happened during the accident or what resulted because of the accident. Insurance companies can use their testimonies to understand what really happened and who is deserving of what compensation. Additionally, a witness testimony can be used to determine who is at fault because they may have witnessed behavior that clearly implicates one of the motorists involved in the crash.

Impact on Insurance Claims

Insurance companies will thoroughly scrutinize the credibility of any witnesses in order to avoid giving out more compensation than necessary. First, they will determine if there are any connections between the involved parties and the witnesses. They will also look for any inconsistencies in the witness’s story. If the witness can’t recall certain events or if they tell the story differently, the insurance company may claim they are not a reliable witness. A witness could also be counted as invalid if they only saw what led up to the crash or what happened right after, rather than the whole thing.

A car accident is scary to experience and a hassle to deal with. Having some witnesses involved can improve your chances of getting the compensation you deserve after a crash. If you work with an accident or injury lawyer, talk to them about calling in witnesses.

Biggest Mistakes Made After a Car Accident

October 5, 2022 by Big Leap

After being in a car accident, it’s common to experience shock and uncertainty. However, there are certain actions you need to make sure you avoid after any kind of accident. Making these mistakes can ruin your chances of getting proper compensation.

Not Seeking Medical Help

No matter the results of your car accident, you should seek medical help if you feel any pain. Often, the injuries you receive are not obvious at first and you might assume you’re fine. However, these injuries can become more serious when it’s too late to receive compensation. Additionally, if you don’t seek any medical attention then it can be difficult or even impossible to prove to the insurance companies involved that you received serious injuries. You need verification from a health care professional that you received injuries and this verification will also explain how serious the injuries were.

Admitting Fault

Under no circumstances should you ever admit fault when you’re in a car accident. Even if you know it was your fault, it’s best to keep your mouth shut. Don’t apologize to the others involved (even though this may feel wrong) because apologizing admits guilt.  It is fine to ask if other are okay, but don’t admit to doing anything wrong.  In any accident, the police should be called and they will investigate the crash and determine who is at fault. Don’t admit anything and let them handle it.

Settling Quickly

Since car accidents are so stressful, it’s natural to want to take care of everything quickly and be done with it. However, this is the wrong approach to have. You want to make sure everything has been thoroughly investigated first, so you can successfully obtain what compensation you need. This includes having a medical evaluation done to see what injuries you’ve sustained and how serious they are. You should also make sure your vehicle is inspected so you know the extent of the damage. Settling quickly can mean missing out on potential compensation. Again, not all injuries are obvious at first and you may receive compensation before realizing how bad your injuries really are.

You need to know what actions you should take after a car accident occurs. If you know common mistakes, you can know what to avoid and you can protect yourself. For further protection, you should hire an injury lawyer to support your case.

How to Recover From a Car Accident

March 23, 2022 by Big Leap

After a car accident, you will have a lot to navigate including sorting out insurance and getting your car repaired. If the accident was bad enough, you’ll also have injuries to take care of. It’s important that you dedicate some attention to recovering from these injuries.

Get Medical Attention

First and foremost, you need to seek medical attention for any injuries you sustain. After an accident, it can sometimes be difficult to know how you were affected and you might even feel fine. However, it’s a good idea to get medical attention in order to see if you have any injuries and to take care of them right away. You also need to seek immediate medical attention if you have obvious injuries. The best way to recover is to start taking care of your injuries as soon as possible. When you seek medical help, you can be told how to best take care of yourself in order to recover.

Rest and Follow Your Treatment Plan

When you’re injured, the best thing you can do is rest. If you get right back to work or to your daily activities, it can take even longer to heal and it may cause more pain. Taking time to rest can allow your body to slow down and heal much faster. As you rest, you also need to follow your treatment plan. This can include taking certain medications to help you recover. You might also receive physical therapy instructions and you need to make sure you do all exercises that are necessary. Your doctors give you a treatment plan for a reason. Following it will help you recover faster.

Get a Support System

Dealing with injuries on your own can make it much harder. You need to make sure you have a support system in place. Whether friends or family, your support system can help you with tasks you can’t do because of your injuries. They can also provide you with services like making you dinner or helping you clean. Your support system can also be there as an emotional support to help you through. Reach out to your loved ones, friends, neighbors, etc. in order to give yourself the support you need so you can recover from your accident.

Your injuries from a car accident can slow you down and even keep you from working. It’s best to find ways to recover quickly and painlessly. Find ways to make your recovery easier.

How to Identify a Drunk Driver

March 9, 2022 by Big Leap

When driving, you can only control your own actions. The decisions that others make on the road are unfortunately the ones that can be the most dangerous. Drunk driving leads to numerous accidents that can cause serious injuries and financial trouble. To protect yourself, it’s worth knowing the signs of a drunk driver so you can avoid them on the road.

Weaving and Erratic Braking

If a driver is under the influence, it can be difficult for them to focus and follow standard driving procedures. One of the most common signs of a drunk driver is if they are weaving through lanes. Often, drunk drivers cannot stay within the lanes or continue straight. If you see a driver weaving a lot, it may be safe to keep your distance. Additionally, if a driver is braking suddenly and at odd times, this may also be a sign that they are intoxicated. In some cases, this behavior could also be the result of distracted driving, such as texting. If it is prolonged and frequent, there’s more of a chance they are under the influence. No matter the circumstances, you want to avoid being close to these drivers so you don’t get into an accident.

Delayed Reactions

Alcohol can slow your reactions to things which is one of the main reasons you should never drive while under the influence. Drunk drivers are more likely to hesitate before accelerating (at a traffic light or stop sign) and they also may not brake in time. Since their reactions are delayed, there is more of a chance that they could cause an accident with someone. While driving, if you see someone who appears to be reacting slowly to what’s going on around them, you should make sure there is plenty of space between you and them.

Illegal Driving

Your actions are severely inhibited while under the influence of alcohol and you are more likely to ignore laws while driving. You may be able to spot a drunk driver if they are breaking certain laws. This can include ignoring signs and traffic lights, driving in an area they shouldn’t, and more. Of course, not all individuals driving illegally are drunk, but it is better to be safe than sorry.

The main lesson here is to keep your distance from someone if their actions indicate that they may be drunk. These types of drivers are more likely to cause accidents and you don’t want to be involved with them.

When Do Most Commercial Truck Accidents Occur?

September 8, 2019 by Erik

When you’re driving your commercial truck—or when your drivers are out on the road—what times of the day and week worry you the most? Is it the weekend, when passenger vehicle drivers are partying? Actually, you might not know that truck drivers are in more danger during business hours.

If you want to avoid trucking accidents, we want to help by answering this question below: “When do most truck accidents occur?” But if you’re already seeking compensation for a trucking accident, call a Las Vegas truck accident lawyer to help.

More Trucking Deaths During Work Hours

According to 2017 accident statistics, the highest number of deaths caused by large truck crashes occurred from about 6 am to 6 pm. Deaths also occurred in other time periods, but a cluster of fatalities shows up around business hours.

Furthermore, the highest incidence of such deaths occurs from noon to 3 pm. This time of day is when fewer passenger vehicles are on the road, allowing truck drivers to drive faster, which can lead to more fatalities.

The Deadliest Day of the Week: Thursday

When examining the days of the week, the highest number of deaths from large truck crashes occur from Monday to Friday. Deaths drop by approximately 40–65% during the weekend (which contrasts with higher accident death rates on the weekend among passenger vehicles).

The highest number of deaths occurred on Thursday of each week, just as many drivers are thinking about the weekend.

If you have been injured in a trucking accident—or have an employee who has—you may need to contact a Las Vegas auto accident attorney.

Good car accident lawyers in Las Vegas have experience with the challenges you’re going through in seeking compensation. We can defend you and help you get the settlement you need. Contact Ahlander Injury Law now.
